Today, the Partner of KJP, Mr. Paweł Kurcman, representing the Polish Chamber of Patent Attorneys, participated in the session of the Parliamentary Committee on the amendment of the Industrial Property Law Act. The aim of this amendment is harmonization our provisions with the Directive (EU) 2015/2436 of the European Parliament and of the Council of 16 December 2015 to approximate the laws of the Member States relating to trade marks. The Act introduces many novelties, including primarily the abolition of the requirement of graphic representation of the trade mark. During the meeting, Mr. Paweł Kurcman pointed to the necessity to extend the vacatio legis with regard to the entry into force of the proposed amendment (the draft was indicated for entry into force in one day after the date of its publication). Although the Directive enforces its implementation into the Polish legal order by January 15, 2019, however, due to the need to continue this procedure in the Senate, the date will probably not be met anyway.
